In a landmark decision, Brazil’s national data protection authority (ANPD) has instructed Meta, the parent company of Facebook and Instagram, to cease using Brazilian users’ personal data to train its artificial intelligence (AI) models.

This directive highlights significant concerns over privacy and the potential misuse of personal data in AI development. On July 2, 2024, the ANPD announced that Meta must halt the use of data from Brazilian platforms to train its AI systems.


The decision was driven by fears of “imminent risk of serious and irreparable or difficult-to-repair damage to the fundamental rights” of Brazilian users. Meta was given five days to comply, failing which it would face a daily fine of 50,000 Brazilian Reals (approximately $8,808).

The ANPD said it had acted over the “imminent risk of serious and irreparable damage, or difficulty repairing fundamental rights of the affected account holders.”

The controversy centers around Meta’s updated privacy policy, introduced in May, which allowed the company to utilize public data from Facebook, Instagram, and Messenger for AI training. This data included posts, images, and captions.

The ANPD’s ruling followed a report by Human Rights Watch, which revealed that the LAION-5B dataset, used extensively for AI training, contained identifiable photos of Brazilian children, thus raising serious concerns about privacy and exploitation.


Meta has expressed disappointment with the ruling, stating that the decision is a setback for innovation and AI development. The company maintains that its privacy policy complies with Brazilian laws and emphasizes that AI training is crucial for enhancing its services.

Meta also noted that it is more transparent than many of its competitors in the industry. However, the ANPD and critics argue that the process for Brazilian users to opt out of data usage for AI training is overly complex and not user-friendly.
